1. Controller and contact

2. Visiting the shop and Shopify
Our online shop runs on Shopify. Visits involve processing IP addresses, device and browser information, pages accessed and access times to deliver the website, troubleshoot errors and prevent misuse. The legal basis is Article 6(1)(f) GDPR; our legitimate interest is a secure, functioning online shop.
Shopify processes shop data on our behalf under an Article 28 GDPR agreement. For its own services, such as Shop and Shop Pay, Shopify may act as a separate controller. See Shopify’s consumer privacy policy and data processing agreement.
3. Orders, payments and shipping
We process contact, billing, delivery, order and payment details to fulfil purchases, send shipping notifications and handle withdrawals, returns and defect claims. The legal basis is Article 6(1)(b) GDPR. Statutory retention and documentation obligations are based on Article 6(1)(c) GDPR.
Data needed for payment is sent to the provider named at checkout. That provider may also act as a separate controller for payment processing, fraud prevention and, where applicable, credit checks. Its privacy information is accessible before selecting payment. Carriers receive the recipient and address details needed for delivery.
Information marked as required is necessary for the contract and delivery. We cannot fulfil orders without it. Optional information is marked accordingly.
4. Contacting us
For enquiries by email, telephone or contact form, we process your contact details and message. Contract-related enquiries rely on Article 6(1)(b) GDPR; other enquiries rely on Article 6(1)(f) and our legitimate interest in responding. Please provide only information needed to handle your enquiry.
5. Newsletter
If you subscribe, we use your email address to inform you about our playing cards, new designs and offers, based on consent under Article 6(1)(a) GDPR. We retain information needed to demonstrate your subscription.
You may withdraw consent at any time for the future using the unsubscribe link in each newsletter or by contacting kontakt@berlin-holdem.com. Withdrawal does not affect the lawfulness of earlier processing. Subscribing is not required to shop.
6. Cookies and consent
Necessary cookies and similar technologies support functions such as the cart, security and saving privacy choices. Where strictly necessary for a service you expressly request, access to your device relies on section 25(2) TDDDG. Subsequent personal data processing relies on Article 6(1)(b) or (f) GDPR, depending on its purpose.
Optional analytics and marketing technologies may be used only with your consent where consent is required, under section 25(1) TDDDG and Article 6(1)(a) GDPR. Merely using the shop does not constitute consent. You can change or withdraw your choice through the cookie settings.
7. Recipients and international transfers
Shop platform and technical service providers, payment providers, carriers, accountants and tax advisers receive personal data to the extent necessary. Authorities receive data when legally required.
Newsletter confirmation
We use Shopify Messaging for newsletter subscriptions and delivery. We use double opt-in: after signing up, you receive an email with a confirmation link. Your subscription is completed and your welcome voucher is sent after confirmation. We retain the subscription status and associated timestamps as evidence of consent. You can unsubscribe at any time using the unsubscribe link or by email.
Shopify may process data outside the European Economic Area. Transfers rely on an applicable adequacy decision under Article 45 GDPR or appropriate safeguards, particularly standard contractual clauses under Article 46 GDPR. 8. Retention
We retain data as long as necessary for the stated purposes. Completed enquiries are deleted unless another retention reason applies. Contract and accounting records are kept for the applicable commercial and tax law periods, notably six, eight or ten years depending on the record type.
Newsletter data is processed until unsubscription. Necessary consent records may be retained for legal defence until relevant limitation periods expire. Data needed for legal disputes is retained until final resolution.
9. Your rights
Subject to statutory conditions, you have rights of access (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction (Article 18) and portability (Article 20). You may withdraw consent at any time for the future.
Right to object: Under Article 21 GDPR, you may object on grounds relating to your particular situation to processing based on Article 6(1)(f). You may object to direct marketing at any time without giving reasons.
Contact kontakt@berlin-holdem.com to exercise your rights. You may also complain to a supervisory authority, particularly where you habitually reside, work or suspect an infringement. The authority for our registered office is the Berlin Commissioner for Data Protection and Freedom of Information.
